  1. PRIMERO. DECLARAR que en el proceso de tutela T-8.188.244 promovido por los senores Marcos Fraynd Szyler, Paul Fraynd Rabinovich, Saul Fraynd Rabinovich y la senora Fanny Fraynd Rabinovich contra la Sala de Casacion Civil de la Corte Suprema de Justicia, la magistrada Diana Fajardo Rivera Martelo se encuentra incursa en la causal de impedimento establecida en el numeral 5 del articulo 56 del Codigo de Procedimiento Penal. En consecuencia, se ACEPTA el impedimento formulado.
  2. SEGUNDO. SEPARAR a la magistrada Diana Fajardo Rivera del conocimiento del proceso correspondiente a la accion de tutela cuyo impedimento se acepta en los terminos de esta providencia.
  3. TERCERO. Contra esta decision no procede ningun recurso.
  4. CUARTO. Proceda la Secretaria General de la Corte Constitucional a librar las comunicaciones correspondientes por el medio mas expedito y adjunte la copia integral de este proveido.
